These Terms of Service ("Terms") govern your access to and use of the website and services of wOWNit LLC ("wOWNit," "we," "us," or "our"). By using our website, submitting an application or referral, or otherwise interacting with us, you agree to these Terms. If you do not agree, please do not use our services.

1. What wOWNit is — and what it is not

wOWNit offers lease-to-own agreements (arrendamiento con opción a compra) for new construction and landscaping equipment. wOWNit is not a bank, lender, or credit provider, and we do not offer loans or extensions of credit. A lease-to-own agreement is not a loan. Any statements on our website about approval, payments, or ownership are general descriptions and are not offers of credit or guarantees.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use our services. Equipment availability, service areas, and lease terms may be limited, including to the Phoenix and Tucson metropolitan areas and other parts of Arizona.

3. Applications and approval

Submitting an application or referral does not create a lease or guarantee approval. All applications are subject to review and verification, which may include verifying your identity, income, and account information (including through Plaid). You agree that the information you provide is true, accurate, and complete, and that you will keep it current. We may approve or decline any application at our discretion and as permitted by law.

4. The lease agreement is separate

If your application is approved, the specific terms of your lease-to-own arrangement — including payment amounts, term length, and the option to own the equipment at the end — will be set out in a separate written lease agreement. That agreement, not this website, governs your lease. In the event of a conflict, the signed lease agreement controls.

5. Communications consent

By submitting a form, you agree that wOWNit and its service providers may contact you by phone call, SMS/text message, and email about your application, lease, or referral. Message frequency varies; message and data rates may apply. You may opt out of texts at any time by replying STOP, and you may unsubscribe from marketing emails using the link in those emails. 6. Dealer program

If you participate in our dealer referral program, any commissions or payments are subject to a separate agreement between you and wOWNit and to the successful completion of a lease with the referred customer. Referral of a customer does not guarantee approval, a completed lease, or payment.

7. Acceptable use

You agree not to misuse the website, submit false or fraudulent information, attempt to gain unauthorized access to our systems, or use our services in violation of any law. We may suspend or terminate access for any misuse.

8. Intellectual property

The website and its content — including text, graphics, logos, and the wOWNit name and mark — are owned by or licensed to wOWNit and are protected by law. You may not copy, reproduce, or use them without our permission.

9. Third-party services and links

Our website may use or link to third-party services (such as GoHighLevel, Plaid, and Meta). We are not responsible for the content, policies, or practices of third parties. Your use of their services is governed by their own terms and privacy policies.

10. Disclaimers

Our website and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, wOWNit and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the website or services. Our total liability for any claim relating to the website will not exceed one hundred dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless wOWNit and its owners, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the website, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or your use of the website will be resolved in the state or federal courts located in Arizona, and you consent to their jurisdiction, except where otherwise required by law or provided in a signed lease agreement.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our services after an update means you accept the revised Terms.
